Malpractice
Our most recent
medical malpractice settlement involved a gentleman who experienced
a life threatening surgical complication following a total hip
replacement procedure. Our initial investigation revealed that the
physician failed to treat the complication in a timely way and that
if proper and timely treatment had been provided, the complication
would have been eliminated without harm to our client. The medical
malpractice insurer initially disagreed but after suit was filed and
the depositions of the defendant doctor and the nursing staff
involved in the post surgical care, the insurer changed its position
and agreed to pay a fair settlement to our client.
Automobile Liability
Our most recent
substantial automobile liability case involved a young man who
suffered a variety of severe physical injuries when a teenage driver
who had been consuming alcoholic beverages drove across the center
line and struck our client head on. The brake pedal of our clients
pick up truck was imbedded in his leg and he suffered a sever ankle
fracture. Our client was unable to work for two years. We filed an
action against the teenage operator of the vehicle and made a
substantial recovery for our client at a formal mediation session.
Another case
currently pending involves a young husband and father who was
tragically killed when the wheels of the truck he was riding in
became trapped over a sharp drop off at the edge of new pavement
installed on a state highway. The truck tipped on its side and
struck an abutment. We filed an action against the State of Vermont
and the contractor that installed the pavement on the ground that
they failed to place highway safety barrels along the edge of the
pavement. The action is pending.
Products
Liability
One currently
pending products liability case involves a young husband and father
who was cleaning a printing press at his place of employment when
his hand was pulled into the machine and severely mangled. We filed
and action against the manufacturer of the machine alleging that the
manufacturer failed to guard the machine properly and failed to
provide clear instructions to the owner and operator of the machine
about safe cleaning practices and procedures. The action is
pending.
In another
recent products liability matter our teenage client was instructed
to operate an old press machine that lacked standard modern safety
mechanisms. The boy’s hand was caught in the machine. Two of his
fingers were severed and one was seriously injured. We filed an
action obtained a recovery for our client at a formal mediation
session.
